Assigning: .TEL domains can be registered by:- Owners or licence holders of a trademark from Dec. 3rd 2008 to Feb. 2nd 2009
- Everyone, for a higher price, beginning on March 23rd 2009
- Everyone, without a higher price, beginning on March 24th 2009
Syntax: during the phase that is reserved to trademark holders, the domain name must be identical to the national trademark, and must be between 3 and 63 alphanumeric characters or a hyphen (except in the first or last position). A hyphen can be used in the domain name to replace a space or other non-alphanumeric character in the trademark name.

Dates: The Sunrise period begins at the registry at 15:00 GMT on December 3rd 2008 and ends at 23:59 GMT on February 2nd 2009. Pre-registration begins at Gandi on November 25th 2008.

Eligibility: owners and licensees of trademarks registered with national effect may apply. Trademarks must have been applied for prior to 30 May 2008, must have been registered prior to the date the Sunrise application is submitted, and must be in full force and effect at the moment of receipt of the domain name application by the Registry. Applications may be based on both word and figurative (device) marks that consist exclusively or predominantly of words. The domain name applied for must be identical to all text or word elements contained in the Eligible Trademark (except space characters, which may be replaced by hyphens; and except special characters, which may be transcribed, eliminated, or replaced by hyphens).
Minimum registration term: 3 years
Selection method / Validation / Reconsideration:
First-come, first-served. The Validation Agent (Deloitte) will review applications for conformity with the Sunrise Policy. If an application is rejected, the applicant will have 10 days to file an appeal. There is a charge for admission of Reconsideration request to the Registry. If an application is accepted, third parties will have 10 days to file a challenge.
Information and documents to provide:
In Your application, You must specify the trademark name, country, registration date, registration number; the applicant capacity (owner, licensee, or assignee of the eligible trademark).
If You are not the owner of the trademark but a licensee or an assignee of the trademark, You must fill and provide the relevant document “License Declaration” for Your Registered Trademark (enclosed to this contract), and send this document and the corresponding domain invoice to Gandi. You must provide, if requested by the Validation Agent, Documentary Evidence to verify the information in the sunrise application, in accordance with the Validation Agent's instruction (e.g. PDF file of maximum 1 Mb, with an English translation).
Eligible Trademarks:
The Eligible Trademark must be:
- identical to the domain name applied for
- owned by the applicant. If the applicant is a licensee or an assignee of the trademark, the Sunrise Application must include a certification from the registered owner of the Eligible Trademark (in the form provided by the Registry) that the licensee is entitled to file the Sunrise Application corresponding to the Eligible Trademark, or that the assignee is the owner of the Eligible Trademark.
- registered and in full force and effect at the moment of receipt of the domain name application by the Registry
- applied for before the 30th of May 2008 and registered prior to date of submission of the application to the Registry
- have a registration with national effect, meaning that the registration is issued by a trademark registration authority having jurisdiction over an entire nation, such as: (a) national trademarks and service marks; (b) Benelux trademarks; and (c) Community trademarks.
- registered in a country, region, locality, or by an organization referred to in the WIPO ST.3 standard (see http://www.wipo.int/scit/en/standards/pdf/03-03-01.pdf)
- registered by the competent public authority or intergovernmental organization referred to in the Sunrise Application (the application must make reference to the corresponding country, region, locality or organization by using this standard)
Ineligible Trademarks: The following are not considered as Eligible Trademarks:
- trademarks or service marks for which an application for registration has been filed, but is not actually registered (or received a “registered” status) by the competent public authority or intergovernmental organization referred to in the Sunrise Application, or has lapsed, been withdrawn, revoked or otherwise is no longer in full force and effect by the time the Sunrise Application is validated by the Validation Agent;
- unregistered (including common law) trademarks or service marks; US state trademarks or service marks;
- international applications made through the Madrid system, unless these are based on or have resulted in a registered trademark of national effect as described above; and
- any other rights to a sign or a name, including Domain Names.
Confirmation: Upon receipt of a Sunrise Application, the Registry shall confirm receipt to the Sponsoring Registrar. Such confirmation shall include, upon other informations, the time and date on which the Registry received the Sunrise Application, and a unique reference number attributed by the Registry to the Sunrise Application. If the application is rejected, the applicant will have 10 days to file an appeal.
Refund Conditions: If the registration failure is due to domain unavailability (not charged by the Registry), You will get a full refund for the failed order. In all cases that are not refunded by the Registry to the Registrar (if Your application is rejected by the Registry and/or its Validation Agent; if a third party has successfully challenged Your domain...), then You will not get any refund for Your failed order. Failure to provide the requested information and/or documents, and/or not comply with the eligibility, technical and financial requirements, will lead to the rejection of Your application, without penalty or refund.
